The payments made under structured settlement annuity do not come under the purview of income-tax and are guaranteed as contract. It is actually a long-term financial security and is a very safe method to pay annuity. Some of the factors considered by individuals are payment, duration, expenses, present age, occupation and retirement plans. Some of the structured payments cannot be altered once these are agreed by both the parties.

Further the support and assistance of federal and state laws also give a strong recognition to the settlement laws and the statutes of law can never be questioned and should only be followed. Federal laws state that court order can be obtained to an extent there are no tax liabilities. Court always issues orders under Settlement Protection Acts and these are in force in nearly 36 states of United States.

The disclosure statement is received by a customer in 3 to 14 days time and once a transfer agreement is received, the disclosure statement mentions the amount to be paid to the customer and the respective due dates. Only after receiving court order, the funding company will begin making payments to the individuals.

Therefore, this is a very nice way of settlement either from the point view of insurance company or from the point view of individual. There are no dissatisfaction and unsatisfied terms and conditions, but everything is carried on as per the instructions and orders of the court.

This means courts are the ultimate authority and there can be no scope for any negotiation in any context after receiving an order from the court. There are lot many differences which are prevented by the interference of court and in fact court is best authority and judge to give instructions on annuity payments. This same agreement can also be established for surviving members of the family. Regular installments can be paid over the lifetime of the injured party or for a set time period.

These types of settlements have become very popular in the legal system of today. All parties involved in these types of settlements can benefit greatly and this has contributed to their popularity. Payments are established on a recurring basis and in some cases a small lump sum portion can be distributed for coverage of financial obligations upfront.

There are a few benefits to structured settlement annuities. There may be a period of time where the installments could be tax-free. There are many investment options available but most do not stack up to the advantages of a Structured Settlement Annuity. Beneficiaries can be established to receive a portion of the settlement in case of the untimely death of the plaintiff. If you have recurring medical bills every month then structured Settlement Annuities will benefit you due to the establishment of the monthly income. Structured Settlements can protect you from you. It is very difficult for people to refuse to give cash to family members and if your settlement is distributed monthly it is much easier for you to just say 'no' due to your monthly obligations. Special trust funds can also be established for those who were severely disabled from the accident and in these cases a qualified financial advisor should be consulted.

The Lump Sum Alternative

Periodic payments can make many recipients feel caged. They may have been planning to use the money for school tuition, new home, new car, home renovation etc. etc. The lump sum alternative may be what they desire. If you are a disciplined individual and can manage your money effortlessly then this could benefit you immensely. With enough research you could find many long-term investments with much greater returns than an annuity. You have to remember, if the sum of the settlement is extremely large then you will need to negotiate to see if you can get some of that cash up-front with the rest in periodic installments. If you have been receiving monthly installments for quite some time and decide you need more cash available then you may desire to sell your settlement. There are brokers working with factoring companies that would be willing to purchase your annuity, just be smart, do your research and make sure you work with a reputable company or individual. On another note you will need to check your states laws on structured settlements. Some states do not allow the sale of a structured settlement.

Which ever course you decide to take, make sure that you consult a reputable Lawyer and Financial Advisor. The benefits could be immeasurable and you could relax knowing you made the right choice and that you will be happy with your decision for the rest of your life.

About the Author: Ken Conger is a freelance writer and webmaster for Smart Annuity Information [http://www.smart-annuity-info.com]

What to Look for in an Annuity

Generally speaking, this allows the buyer to have an income stream until death or some pre-determined event. However upon the pre-determined event this payment disappears and the investment amount disappears and goes to the benefit of the annuity company. Many people typically use annuity payments as a way to supplement and stabilize their investment. A holder should be cautious of counter party risk and inflation risk. Counter party risk is the risk that the company may run out of financial resources. The risk if often minimized by the requirements that the annuity holders investment must be kept in separate accounts under current regulations. Inflation risk is the risk that payments will be worth less in the future due to inflation of the currency.

The types of annuities vary, but the most common type are fixed. These yield a set amount of income in duplicate payments. Typically these will be reoccurring monthly payments. These payments are typically used as an offset of an investment, much like a bond or other interest yielding investment. This varies from a variable interest annuity. A variable interest annuity is one where a future payment is dependent upon some variable, such as future interest rates. Other factors that can impact future investment options include total investment return, current treasury yields, or the rate of bonds.

If you have an annuity, some allow you to take a loan from it. An annuity loan allows the holder to access their initial investment, though this will often lead to lower future annuity payments. An annuity holder can also sell his annuity. If an annuity holder decided to sell your annuity, the annuity holder loses his annuity holding, the future stream disappears but he receives his value of his annuity. This is a difficult decision for an annuity holder and that annuity holder should consider receiving annuity advice.

If a holder wants to remove the investment due to current financial difficulty, one can also use a settlement option. An annuity settlement option involves an annuity holder reaching an agreement with the annuity company to remove the annuity payment in exchange for the annuity. This often involves a penalty and reduced liquidation payment. As such, this should often be the last resort unless the annuity holder is in financial distress.

Determining to enter an annuity contract is a difficult choice. This type of investment involves a current or future income stream, depending on the type of investment, and allows you the ability to supplement your salary or retirement income. However upon a pre-defined event, typically involving your death, the investment is lost. As such, your investment in the annuity is lost. As such, deciding to enter into this type of contract is also one in which you determine if your current benefit is worth your legacy payments to your future generation.

For more information on an annuity, please visit http://alrenn.com/a-guide-to-annuity-rates

Where Do You Find A Qualified Buyer of Structured Settlement Annuity?

Finding a qualified buyer of structured settlement annuity is much easier these days thanks to the Internet. With just the click of a mouse you have access to the top note buyers in the country, and you can sell your annuity in a matter of days. It's just a question of finding the right buyer.

Many people find at the beginning or over time that the monthly payments they receive as part of a structured settlement no longer work for them. They might need an immediate source of cash, might be looking to retire or just might not want to assume the risk anymore. Whatever the case may be, there are professionals who are willing to purchase these settlements and assume the risk for you.

It's important to remember that you do not have to sell your entire note. Rather, you can tell the buyer of structured annuity settlement that you only want to sell a portion of it. This is called a partial and it is a common way of structuring the deal. Here's an example of how this works:

Let's say you have a $100,000 settlement paying over 5 years. You need $40k now for a new investment. Well you can sell $40k worth of payments (however many months that works out to be) and retain the rest of the monthly income. Once those payments are made, you resume right where you left off and start receiving your monthlies again.

There are other ways to sell as well, and a knowledgeable buyer of structured settlement annuity will be able to explain all of them to you. After hearing all of the options you can decide which works best for your particular financial situation.

How much will you get for your structured settlement?

That depends on a number of factors, including but not limited to the remaining balance, months/years left, inflationary concerns, timeliness of payments and the financial stability/reliability of the payor. The buyer of structured annuity settlement will take all of these into consideration to come up with their valuation. Often the lawsuit is in reference to an injury case, which results in an insurance agreement. This payment is financially planned to guard the settlement sum and to offer the beneficiary with safe returns. Often the receiver is incapable of work, restricted in work capacity or has endured loss in earnings due to work absence as a result of injury. The structured settlement, also known as an annuity settlement, offers the receiver a long-term, steady and tax-free income.

An annuity settlement or a structured settlement uses annuities as a mode of compensation. However they have a basic difference. A regular annuity is a result of an investment or retirement option, whereas a settlement is a result of an injury or insurance settlement.

To ensure an annuity settlement payment remains tax-free and protected for its tenure, a beneficiary cannot ask for payment augmentation or payment advances. At times this is a predicament incase the receiver needs quick cash or a large sum of money. In such scenarios one may search for an annuity buyer.

Through an annuity buyer, one can sell settlement payments for money. The process allows a person to get the cash that is needed at a time, while the buyer takes over ones annuities and collects the payments as prearranged.

If one has an annuity settlement, it is beneficial as it provides a continuing and steady income in case of accident related disability. Nevertheless, need for money may arise at any time. Hence, in situations like this it is advisable to sell annuity settlement at a bargained price to be able to use the money to its full potential.

Sell Annuity provides detailed information on Sell Annuity, Sell Annuity Payment, Sell Annuity Settlement, Sell Health Annuity and more. Insurance settlements are normally one time settlements given to the affected party or the claimant. The structured Annuity settlement (also called as 'Structured settlement') can be called as an extension of the benefits over a longer period of time. In other words, the victim gets a fixed amount periodically instead of getting the money in one lump sum. Such periodical income would normally last till he fully recovers and is able to take up his normal work.

Legal aspect:

It is said that the concept of structured settlement was first practiced in Canada in 1970. Later several other countries resorted to this procedure. Considering the advantage of this form of payment of compensation to the accident victims, several countries passed laws to legalize. This type of structured settlement is also called as 'periodic payment judgment'. The Annuity is decided depending on the nature of injury, time normally taken to fully recover, type of immobility of the victim, the status of the victim, etc.

Structured Annuity settlement Vs one time settlement:

In one time settlement, the victim has to suit his budget to the compensation received. This is particularly difficult when the victim is immobilized for longer duration of time. The victim will have to manage the medical expenses, domestic expenses, etc. within the compensation received and there is likelihood of the funds depleting. Instead, under the Structured Annuity settlement, the victim gets the compensation for a longer duration. He is assured of some periodical income till he recovers. With this amount, the victim can maintain his family, pay children's school fees, the expenses towards food, medical expenses, etc. As a result, the victim's daily life is not affected. Now this type of settlement is becoming more and more popular.

Brian Sibet also writes about Retirement Planning and Annuities including Lump Sum Annuity.

Good Investments With Annuity Settlement

Annuity settlement usually results from judicial proceeding. It takes the form of a structured settlement payment program in agreement with a third party. Ordinarily these resolutions are legal, though they can also be associated with a life insurance or other insurance policy payout as well. A structured settlement ordinarily consists of periodic payments hit over a reasonably long time frame. These payments are made on a regular schedule to the individual who has received the settlement through legitimate process. The payments could also be channeled to a beneficiary in cases like the life insurance payout.

Disregarding of how annuity settlement occurs, the funds it yields can be significant. The only negative thing about this is the length of time before the investor receives all the amount agreed. Most people who receive a structured settlement need their money sooner rather than later, making the statutory payment arrangements impractical. Out of immediate financial necessity, many individuals who acquire structured resolutions determine to sell their annuities in order to have more instant access to a big portion of the whole value of the plan. And there are a lot of techniques to sell your annuities.

Many individuals will use the services of a financial planner or agent in their sales efforts. These experts could help you in looking for buyers and also in creating a fair deal for the seller. They also can aid individuals on their search for Good annuities for purchase. In general, the role of a financial agent is to look for a achievable sales for investors who gets the settlement, while, on the other hand, provide the buyers with a solid annuity investment. So if you are planning to sell your annuities, try to study that you are going to get a remarkable smash on the value of our annuity.

Also, don't forget that withdrawing your annuity could leave you with penalties. Selling an annuity usually requires that you accept less than the total value of the annuity in order to complete the sale. Investors are always looking for a good deal, and as your annuity has not yet reached full maturity, you may be required to forfeit at least some of your monies in order to access the large chunk of the money you need. buyers and sellers alike should realize that any deal which is processed by a broker or other financial professional will result in fees. The buyer fees may reach up to 15% of the whole amount of value, but, if you have a secure annuity settlement that is long-term, chances are it could be lowered.

For more info on annuity sales leads and to learn about annuity settlement visit structuredsettlementcashguide.com!

Annuity Settlement Options - Annuitize Or Lump Sum?

Annuity settlement options can be puzzling. Many people have purchased annuities of all types for the tax deferral feature. For many retirees the time has come to make the shift from accumulation to payout. Here are some considerations to help determine what's best for you.

The most popular annuity settlement option is annuitization - to take payments over a time frame that you select, which may include the rest of your life. When you annuitize, you receive payments (monthly, semi-annually, annually) in exchange for surrendering your annuity to the annuity insurance company. Your annuitization options usually include:

Lifetime Income

Period Certain

Period Certain Plus Life

Here is how Lifetime Income works. Let's say you have $100,000 in an annuity and the insurance company calculates that, due to your age and gender, it will pay you $1,500 a month for as long as you live. You collect $1,500 the first month, $1,500 the next month, and $1,500 the following month. Then you get run over by a truck and die. You bet the insurance company you would outlive your $100,000 and you lost. $4,500 is all you get; they keep the rest. This is maybe not such a good deal.

Your second option is called Period Certain. This means you can take your money out over a period of 5, 10, 15, or 20 years. The insurance company guarantees to pay out all your money (plus interest) over that period. If you do not live to the end of the period, your beneficiary gets the remaining money in your annuity over the balance of the period. Live or die, you or somebody else gets back all your money.

The third option is Period Certain Plus Life. Here the insurance company guarantees to pay you a check each month for a certain period of time, plus, if you live beyond that period (even if you live to be 150 years old) you'll receive monthly income that you cannot outlive.

The choices are not so simple. A monk in a monastery, for example, may well expect to live to a ripe old age and do better with a Lifetime Income (Although I wonder what he would spend the money on). Someone with a terminal illness may want to take a lump-sum settlement or a 5-year Period Certain. Take a close look at factors such as your health and spouse's health, your age and spouse's age, other sources of income, and your tax bracket.

For more flexibility you could opt for Systematic Withdrawals. In this case, you would receive a fixed percentage of the account value or a fixed monthly amount. You could stop this arrangement at any time and simply withdraw your remaining balance.

Although Systematic Withdrawals appear to have advantages over annuitization, note these two differences: With annuitization as your annuity settlement option, you can lock in a guaranteed monthly income regardless of the performance of your annuity. In addition, annuitization lengthens the tax deferral period since only part of each payment is taxed. The IRS considers the other part of your payments a return of principal.

Finally, you may want to just keep the annuity growing and not take payments at all. Some annuities, however, do not allow this and force withdrawals by a certain age. One option for you is a tax-free exchange to another annuity that may have more liberal withdrawal requirements, but watch out for surrender charges on your existing policy.

You probably never thought getting a check could be so complicated. It's really not as messy as it sounds. In fact, I have annuity agents all across America who specialize in solving such problems. There is no charge or obligation. Sometimes, however, any one of us may have need to plan for the future differently. Our plans may change, we may require cash fast and decide to sell the annuity or part of it for a large lump of cash.

Annuities are usually paid annually in small amounts and for some people, it may not be enough to support their lifestyle. Many people need cash today to invest in their own business even after retirement, some may have loans to pay off, or many people with good financial standing would rather have a large sum in advance, than having small payments deposited annually. Selling your annuity may give you more leverage for your "future" money, today.

It must be noted that selling your annuity, may have tax implications so it would be wise to have some idea of your situation.

There are a few reputable financial companies on the market that will work with you and based on your situation, provide you with the plan that may suit you best.

Even if you have already decided to sell your annuity, it would be extremely wise to shop around. Whether you have a structured settlement from a lawsuit or your annuity is just a personal investment, there are experienced, professional note buyers who will purchase all or just part of your annuities.

The idea of a tax-free steady source of monthly income is appealing for many people, as it allows them to pay various bills and it is is something that comes in month after month, usually for many years. Some individuals invest in annuities on their own or through work, and annuities are quite common when it comes to structured settlements in injury cases.

But many people find themselves in a position where they need or want an immediate source of cash and they'd like to sell annuity settlement. There are many reasons for this. They might have come across a huge investment opportunity. They might be looking to retire. They might want to make a big purchase. Perhaps they just don't want to wait for a small check each and every month, or don't want to assume the risk of the payor defaulting for one reason or another.

Whatever your own personal reason may be, you can quickly and easily sell annuities without any headaches or hassles. You can usually do this within 10-14 days, especially with an experienced, reputable note buyer. He or she will let you know what your options are so you can make an informed decision. Some individuals choose to sell annuity settlement in its entirety which would yield the largest amount of cash. Others sell just a portion of their annuities, retaining some of their monthly payments.

How much will you get when you sell your annuities?

There are many factors that your note buyer will take into account when evaluating your annuity. Some of these include: balance and time remaining, regularity of payments to date, inflationary concerns, financial stability of payor and other details. Remember, it has to make sense for them financially otherwise it's not worth buying.

The best way to get top dollar when you sell annuity settlement is to keep careful notes of all transactions, and retain a copy of all paperwork from when the annuity was first set up. The more you are able to provide to the note buyer the better off you'll be. Don't forget that you have options, so you don't have to sell the entire annuity. There are several ways to structure it so you get a lump sum and continue to receive some of the payments each month.

If you do decide to sell annuities, make sure you find an experienced note buyer who can offer you a competitive rate for your annuity settlement. Discuss all of your available options and decide what's best for you.

Jamie has been working in the finance industry for many years and is a contributing editor to http://www.selling-your-note.com. Especially when there are bills to pay, a house to purchase, or any other reason you can come up with to need a larger sum of cash than you are currently receiving. The good news is that there is help just around the corner, just waiting for you to ask. Companies abound with opportunities to purchase your structured annuity payments for a lump sum. All you have to know is how to find one of them and negotiate the best deal for you.

Sounds easy doesn't it? Well, consider this. Investors are not in the business of merely helping people out of a jam. Their main concern is adding to their own bottom lines. This is where your own knowledge comes in. You have to understand what is a good deal and what isn't BEFORE you sign the contract in front of you as you won't get a second chance.

So, how do you go about making sure that you are getting the most out of your structured annuity payment exchange? Read on:

First of all, selling your annuity isn't an all or nothing proposition. You can elect to only sell a portion of it. This works well for people who need to address an immediate financial need and want the security of knowing that after that need is met, there will still be a annual sum of cash paid to them for a specific period of time. Also, if your payments were awarded through a court, you will need to get court approval to sell those payments. Only selling a portion of those payments will make it easier to gain the approval you need.

Research research research! You need to understand who it is you plan on doing business with. Be wary of any company or investor who tells you that they can give you the cash you want without having to go through the court system. While it may seem like a huge pain in the you know what, the court oversight system actually protects you from shady investors, so while you may be forced to spend the day at the courthouse, rest assured its for your benefit.

When researching, you should also note that big companies like JG Wentworth and Peachtree may not give as good of rates to you as some of their smaller but still high-quality competitors.

For more information or a free quote on selling your annuity settlement, contact Professional Settlement Buyers [http://professionalsettlementbuyers.com/]

Annuity Settlements - A Highly Dependable Plan

An annuity settlement is an agreement where an insurance company continues to pay to an individual for a time period, in case of an accident. In the event that this is so, the following answers may be helpful:

How do you define structured annuity settlements? A structured annuity is when an insurance company gives out cash installments as payment to a qualified individual (for instance, he suffers an accident taken care of by insurance).

During a set amount of time, cash payments will periodically be made. Generally, this time period last as long as the claimant is alive. The cash installments may be paid through a variety of ways, including following a flat-rate amount, cash settlements and even lump sums.

You might wonder, what is the underlying mechanism that drives structured annuity settlements? A structured annuity settlement is a long duration contract, hence it becomes imperative that the people involved (especially the person who is entitled to receive it completely understand the following components: the policies for settlements, the payment schedule, the amount of each payment, and where it should be sent. He should even possess relevant documents (like a copy of the agreement and also the annuity application). The legal and regulatory problems with a settlement broker can be hard to assess.

What are some of the pros to structured annuity settlements? Those who get settlement disbursements can look forward to long-range financial peace of mind. Additionally, the money for annuity agreements is tax-free, on the condition that payment structures would stay the same as per the original agreement.

What are some of the cons to choosing a structured annuity settlement? Even though structured annuities have their benefits, your cash value of the total sum to be paid will depreciate. For instance, someone is supposed to receive $2,500 per payment. While in 2009 this might be significantly high, as inflation along with different variables (reasons like an economic recession, etc). The value of this will diminish over time. A lump sum can be obtained and is desirable to a structured annuity. This might be specifically a reality for persons who have a requirement for fast cash to cover expenses, or for investment purposes.

Many private financial companies have this option available. The Internet can be a great source of information on these programs. If you want to learn further information about structured annuities, search the internet for relevant websites. Here are several useful websites about structured annuities: http://www.structured-settlements-guide.com and http://www.integrityfunding.net/.

What are some helpful tools I can use to better understand this? There are many sites on the internet that can spell out the intricate details of the structured annuity settlement. Some info you may look out for include the relevant laws and regulations applicable to your area. Within the USA, for instance, Federal IRS statute 104 provides a description of structured settlement). It 'better to do with a buyer in a single point of contact. Need a lump sum on retirement in this way. In addition, an ideal buyer, you pay the required amount according to your agreement on the deals that the company is based.
Agenda
The services offered by a buyer structured settlement can be achieved in crisis, if one. How it works

First of all, what is a pension? An annuity is a form of structured settlements, where the owner receives regular pension payments from a sort of court ordered more appeal. Although this form of structured settlement, there are also frequent lottery winnings, and seller financed mortgage notes that the same qualities.
Why would anyone sell an almost guaranteed income Power and give up that cash flow? Could it be that the revenue source set up to pay for a long period with relatively low payments. A person must use a larger lump sum of money for a down payment on a house. If so, what is needed, there are companies out there who specialize in pension for a lump sum of cash for the income stream o.
There are a few things to note in the sale of an annuity or other structured > Settlement. If an investor wants to buy current income to you, he is willing to give the cash value of the pension is less than the total payments are going to receive life. In other words, the total payments for what they are worth today are discounted using the required rate of return or interest rate, the investor. This can be used as an interest rate that would be the capital for the sum of the payments at the end of the consultation to achieve> Pension.
You must realize that the sale of an annuity is a fairly complicated legal procedure, a stock sale did not like, and can take up to 10 weeks to complete the transaction. There are rules and regulations surrounding the transfer of payments and would be virtually impossible without an adequate legal support to do. Choosing the right company to handle, is high on the priority list.
Another thing to do is decide what you want to sell is the source of income. In mostCases you can choose to rent or sell all or part of your. It may not be enough to buy a car, so that payments are to vote to sell are transferred to the buyer, and then draw the rest of you. Again, it would be a specialist in this field as well.
Finally, you need to shop around for the best deal. Pension Remember, when selling, high rate of interest at a rate of discount used to be like is worse than a lower rate. In essence, this is the return onInvestors require. The less you need, the more money you receive in your distribution package. Search on reputation, interest rates and fees and

<link rel='alternate' type='text/html' href='http://settlementannuity.blogspot.com/2011/08/want-to-be-your-annuity-sell-how-it.html' title='Want to Be Your annuity sell? The latter is very difficult to produce and can affect their business tremendously.
With the advent of money for structured settlements, both parties will be a win-win situation. Who pays can do it easily yourself to get the structured settlement annuity, and you will see, what they justly deserve.
This type of court settlement has been around since the 70's. There are many ways for this to happen, and you can choose to sell all or only some, or a percentage of your structured settlement payments. This is usually to meet the financial requirements or to pay unexpected expenses such as a charge to recover Financial support from the implementation phaseWait for access to cash faster and better control over a sum in excess of payments to be made.
structured settlement payments are not due to fortuitous circumstances, the vast majority of cases, although sometimes for profits, they do. The agreements reached are not always ideal for the recipients. These two are combined to ensure the financial stability of the applicant. The plaintiffs have reached an agreement outside of the structured settlement annuities and in combination, although the judge. The great advantage of this system is the long-term financial satisfaction. An insurance company takes overresponsible for regular payments for a specified period, the victims remain free of future financial situation of the accused.

How does it work?
A structured settlement and pension package works in a simple manner. Once a judge granted the decision of the plaintiff, he or she is approached by the lawyers of the defendant. The negotiations were conducted and an agreement is reached if the parties agree to its contents. Under this agreement, theDefendants agree to pay the compensation and the grant of a pension plan. Insurance is the applicants at the shop where the defendants to pay for the pension plan in the name of the file.
